This page describes the terms and conditions (“Offer Terms”) that apply to OhmConnect’s Energy $50 Amazon Gift Card Offer (referred to in these terms and conditions as the “Promotion” ”), open to new OhmConnect Energy customers residing in Texas, all as further described below.
PLEASE READ THESE OFFER TERMS CAREFULLY AND IN FULL. THEY CONTAIN CONDITIONS AND RESTRICTIONS ON THE PROMOTION AS WELL AS INFORMATION ON WHAT HAPPENS IF YOU FAIL TO COMPLETE THE OHMCONNECT ENERGY REGISTRATION PROCESS AFTER RECEIVING YOUR SMART THERMOSTAT, INCLUDING WHEN YOU CAN BE CHARGED FOR THE FULL PRICE OF THE SMART THERMOSTAT PLUS APPLICABLE TAX IF YOU FAIL TO TIMELY CONNECT THE SMART THERMOSTAT TO OHMCONNECT ENERGY WITHIN THE PERIOD SPECIFIED.
OhmConnect Energy delivers reliable and affordable fixed-rate electricity across Texas and encourages customers to reduce their energy use during periods of high demand. The Promotion is available to residents of Texas who are new OhmConnect Energy customers. OhmConnect Energy customers are automatically enrolled in the demand response program when they join OhmConnect Energy. Promotion participants are referred to in these Offer Terms as “Participants.”
These Offer Terms incorporate by reference OhmConnect’s general Terms of Service and are meant to be consistent with and supplementary to the general Terms of Service. In the event of any inconsistency or direct conflict between these Offer Terms and the general Terms of Service, these Offer Terms will prevail.
These Offer Terms are meant to be consistent with and supplementary to the Terms of Service, and any other terms imposed by the smart plug or smart thermostat manufacturers or licensors of the smart plug or smart thermostat (as applicable). In the event of any inconsistency or direct conflict between these Offer Terms and the Terms of Service, these Offer Terms will prevail.
Subject to availability, OhmConnect will provide a $50 Amazon gift card to each Participant who completes the eligibility requirements between June 7, 2023, at 12:01 AM Central Time (CT) to December 31, 2024, at 11:59 PM (CT) (the “Promotional Period”), including enrolling in an electricity plan, creating an account, and becoming an active OhmConnect Energy user by December 31, 2024. The Promotion cannot be combined with any other OhmConnect Energy promotions or offerings. OhmConnect Energy reserves the right, at its sole discretion, to suspend, modify or terminate the Promotion for any reason or for no reason. All information collected by OhmConnect Energy in connection with the Promotion will be collected and used in accordance with the Privacy Policy.
To be eligible for the Promotion, you must satisfy all of the following conditions and steps:
To reserve your $50 Amazon Gift Card, you must complete steps 1-2 on or before December 31, 2024, at 11:59 PM (CT) and within 30 days of creating your OhmConnect Energy account.
Step 1: Set up an OhmConnect Energy Account. Participants must become first time, fully enrolled customers of OhmConnect Energy. To do so, visit the OhmConnect Energy page and create a new OhmConnect Energy account by providing your email address, zip code, first name, and phone number and creating a password. To become an OhmConnect Energy customer, you must agree to the OhmConnect Terms of Service.
Step 2: Become an Active User of the OhmConnect Energy Platform. Become an active OhmConnect Energy participant before the end of the Promotional Period, including by engaging and participating with the OhmConnect platform, communications and/or events.
You are solely responsible for purchasing, maintaining and using at your own expense all utility, Wi-Fi, access to the internet, communications and other equipment and devices necessary to participate in the Promotion.
Employees, officers and directors of OhmConnect Energy, its parent, subsidiaries, and affiliated companies, advertising, promotion, and production agencies, Webmasters and Web suppliers, their immediate family members (parents, grandparents, children, siblings, and spouse of any of the foregoing) regardless of where they live and individuals residing in their same household, whether related or not, are not eligible to participate in the Promotion.
Any fraudulent, deceptive or illegal activity, including using automated, robotic methods of online participation, and tampering with or abusing any aspect of the Promotion, as determined by OhmConnect in its sole discretion, will result in disqualification from the Promotion. OhmConnect may also prosecute such persons to the full extent of the law.
From time to time, OhmConnect may change these Offer Terms. If it does so, the “Last Updated” line above will be revised. You are responsible for regularly reviewing these Offer Terms. Your continued participation in the Promotion following the posting of changes to the Offer Terms indicates your acceptance of those changes. OhmConnect also reserves the right at its sole discretion to suspend, modify or terminate the Promotion for any reason or for no reason.
